    Terms and Conditions for Tennis Lessons

      Online registrations for tennis lessons are pre-registrations. We assign participants based on age, level, and availability.

      The right to participate in a course from 359.tennis CV only arises after receipt of the course fee.

    3. 3

      By signing the online registration form or submitting the online form, you have entered into a payment obligation, even if you do not exercise the right to participate in the course.

    4. 4

      In case payment has been made and no course can be organized at the desired time, an immediate refund will be provided.

    5. 5

      In case payment, whether partial or full, has been made and the lesson time and day have been set according to the stated available times and days, or later mutually agreed upon, no refund in any form is possible if the course is not used.

    6. 6

      In case 359.tennis CV decides to cancel the payment obligation of course participants or to refund already paid course fees, the terms for refund will be determined on a case-by-case basis.

      359.tennis CV reserves the right to refuse registrations.

    8. 8

      Participation in any tennis lesson/course is personal and non-transferable.

    9. 9

      Course days and/or times missed for any reason are at the expense and risk of the course participant.

    10. 10

      Only private courses can, if notice is given at least 48 hours in advance, be rescheduled a maximum of 1 time per season to another time within the course period. The payment obligation does not expire as a result.

    11. 11

      A tennis lesson lasts 50 minutes.

    12. 13

      If the organization deems it necessary, changes may be made (in mutual consultation) to the times and days on which the lessons take place.

    13. 14

      Juniors are those who have not yet reached the age of 18 by January 1st of the lesson year.

      OUTDOOR tennis lesson courses take place on the Tennis Courts of TV De Kegel in Amstelveen from April to October of each year. To participate in the courses, the participant must be a member of TV De Kegel, and have paid their membership fee and tennis lesson fee.

    15. 17

      OUTDOOR tennis lessons will be moved to indoor tennis courts of NTC Amstelveen De Kegel in case of rain, events, or competition on the outdoor courts. Participants pay no extra court rental costs compared to the regular outdoor rate if lessons are moved to an indoor tennis court. If no indoor tennis courts are available for the lesson to continue, the tennis lesson will be rescheduled in mutual consultation.

      WINTER / INDOOR tennis lesson courses take place year-round on the indoor tennis courts of NTC de Kegel.

    17. 19

      During events or coach illness, lessons may not be able to proceed and may need to be rescheduled to a different day and/or time. Rescheduling lessons due to force majeure will be done in mutual consultation with students.

    18. 20

      Participation in INDOOR tennis lessons is open to everyone. Both members and non-members can participate. A membership is therefore not required to take lessons on the INDOOR courts.

      Tennis lessons will in principle always continue.

    20. 22

      Classification by level and appointment or assignment of an instructor is reserved to the organization.

    Article – Protection of Methodology and Intellectual Property

    The 359 development system, including but not limited to the Fit–Fun–Focus development philosophy, the 359 rewards system, evaluation structures, progress cards, coach manuals, training materials, visual models, roadmap structures, presentations and training documentation, is an original intellectual creation of 359.

    All aforementioned materials are protected by copyright and, where applicable, trademark rights and other intellectual property rights.

    Without prior written permission from 359, it is not permitted to:

    1. (a)copy the methodology in whole or in part;
    2. (b)commercially apply the structure or design;
    3. (c)distribute internal documents;
    4. (d)reproduce training materials;
    5. (e)use the system or parts thereof for own commercial purposes.

    Public communication about the vision of 359 is permitted, provided it does not lead to reproduction of internal models, documents or methodological structures.

    Violation of these provisions may result in legal action in accordance with Dutch copyright law and other applicable legislation.

    Article – Imagery, video and progress within 359.tennis

    359.tennis works with the 359 Method and the 359 Progress System. Within this system, photos, video recordings and observations may be used to support development, coaching, parent communication and quality assurance.

    Internal use of imagery and video can be part of the service. This use is limited to coaching, progress tracking, coach development, quality assurance and internal handover within 359.tennis.

    External use of recognisable imagery for the website, social media, promotion, testimonials, cases, advertising or external presentations only takes place when separate consent has been given. Participation at 359.tennis is not dependent on granting external publication consent.

    Parents or legal guardians can adjust or withdraw consent for external use at any time for future use via [email protected]. 359.tennis does not publish vulnerable, sensitive, negative or misleading imagery and does not use a minor's full name alongside recognisable imagery without separate consent.
